Notification of No Trespass Order Forms

330.01.     PURPOSE.

To provide Augusta Department of Public Safety officers with the guidelines for the proper use of the ADPS "Notification of No Trespass Order" form.

330.02.     POLICY.

It is the policy of the Augusta Department of Public Safety to offer, when requested or when applicable, a "Notification of No Trespass Order" form to local property owners, the owner's agent, lessee, or person with lawful authority over property within the City, for the sole purpose of providing a uniform means for such parties to document previously issued no trespass orders.

330.03.     PROCEDURES.

The only "Notification of No Trespass Order" form to be offered to any person having authority to issue such orders, by any ADPS officer, is that which has been previously approved by the Director of Public Safety.

The ADPS will not act as a repository for "Notification of No Trespass Order" forms; it will be the sole responsibility of person(s) having authority to issue such orders to maintain their own records.

ADPS officers cannot be the affiant in a case of "Criminal Trespass" as defined by K.S.A. 21-5808 and Ordinance 6.7 of the Uniform Public Offense Code of the City of Augusta, Butler County, Kansas. A "Criminal Trespass" investigation based solely on the validity of a previously issued verbal or written no trespass order shall only proceed after the verbal no trespass order and/or the information contained on the "Notification of No Trespass Order" form can be currently verified by a person having authority to issue such orders.

If a case is created, which, by its nature makes it appropriate to copy a "Notification of No Trespass Order" form acquired from a person having authority to issue such orders, the form shall be kept exclusively in the case jacket.

No record, list, database, spreadsheet, or catalogue of any other type concerning such completed "Notification of No Trespass Order" forms will be kept by any ADPS officer.
